1. About us and these terms
Homesophisticated.com is operated by CONCLAVITY SOLUTIONS LTD, a company registered in England and Wales under company number 16186383, with its registered office at 30 Riverhead Close, London, England, E17 5PY (“we,” “us,” “our“).
These terms apply to every order you place with us for physical and digital products relating to home, garden, and homeware. By placing an order, you agree to be bound by these terms. Please read them carefully before ordering, and keep a copy for your records.
Nothing in these terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Eligibility
To place an order, you must be at least 18 years old and able to enter into a legally binding contract. If you are under 18, please ask a parent or guardian to place the order on your behalf.
3. Our products
We sell physical homeware, garden, and lifestyle products, as well as digital products (such as downloadable guides, templates, or design files). We make every reasonable effort to display product images, colours, and materials accurately, but slight variations can occur due to photography, lighting, and screen display settings, and packaging may differ from images shown. Product descriptions are provided in good faith, and we’ll correct any genuine errors as soon as we become aware of them.
4. Pricing and payment
- All prices are shown in pounds sterling (GBP) and, where applicable, include VAT at the applicable rate.
- Before you complete your order, we will show you the total price you will pay, including delivery charges and any other mandatory fees; we do not “drip” additional mandatory costs onto you later in the checkout process, in line with UK consumer pricing law. Any optional charges (such as gift wrapping or expedited delivery) will be clearly identified as optional.
- Payment is taken via our third-party payment provider(s) at the point of order. We do not store your full card details.
- Pricing errors: Despite our best efforts, occasionally a product may be listed at an incorrect price. If we discover a pricing error before we’ve accepted your order, we’ll contact you to let you know and give you the option to reconfirm at the correct price or cancel. If we discover the error after dispatch and the error was obvious and could reasonably have been recognised as a mispricing, we may cancel the order and refund you in full.
- We may change our prices at any time, but changes won’t affect orders we’ve already accepted.
5. Placing an order and how contracts are formed
Adding items to your basket and completing checkout is an offer by you to buy those products. We will send you an order acknowledgement email confirming we’ve received your order; this is not acceptance of your offer. A binding contract is only formed between us when we send you a dispatch confirmation (for physical products) or provide you with access to the digital content (for digital products).
We may decline or cancel an order at any stage before that point, for example, if a product is out of stock, if we identify a pricing or listing error, if we suspect fraud, or if we’re unable to obtain authorisation for payment. If we cancel an order after payment has been taken, we’ll refund you in full without delay.
6. Delivery of physical products
- We currently deliver to addresses within the United Kingdom only.
- We will deliver within the delivery period shown for your item at checkout. Delivery times can vary due to customs, courier or peak-period delays, and we will keep you updated if your order is delayed.
- Risk in the products (i.e. responsibility for loss or damage) passes to you when the products are delivered to you or to a person you’ve nominated to receive them.
- If no one is available to accept delivery, our courier may leave the parcel in a safe place or with a neighbour, or arrange redelivery, depending on the courier’s own policy.
- If you believe your delivery is significantly delayed, please contact us; you may have a right to cancel and receive a refund if we miss an agreed delivery deadline that was essential to you.
7. Digital products
- Digital products (such as downloadable files, templates, or guides) will be made available to you by download link or account access, usually provided immediately or shortly after payment is confirmed.
- Unless we say otherwise, digital products are licensed to you for personal, non-commercial use only. You may not resell, redistribute, or share the files with others.
- We provide digital content that is of satisfactory quality, fit for purpose, and as described, in line with the Consumer Rights Act 2015. If digital content you’ve bought from us is faulty, you’re entitled to have it repaired or replaced within a reasonable time; if that’s not possible, you can request a price reduction, which can be up to a full refund.
- Our digital products are supplied with stated system requirements and installation instructions. Please check these before purchase and keep your software up to date. We are not responsible for issues arising from use on incompatible devices or from not following our instructions.
- Nothing in these terms limits your statutory rights regarding digital content.
8. Your right to cancel (cooling-off period)
If you’re a consumer buying physical goods from us, you have a legal right to change your mind and cancel your order within 14 days, without giving a reason, under the Consumer Contracts Regulations 2013. This cooling-off period runs from the day you (or someone you nominate) receives the goods.
To cancel, simply tell us clearly, by email, post, or using our returns portal if we provide one, that you wish to cancel. You then have a further 14 days from telling us to return the goods to us.
Refunds: Once we’ve received the returned goods (or evidence that you’ve sent them back), we’ll refund you within 14 days, including the standard delivery cost you originally paid (but not any premium delivery upgrade you chose). We may make a deduction if the value of the goods has been reduced by unnecessary handling on your part beyond what’s needed to establish the nature, characteristics, and function of the item.
Who pays return postage? Unless the item is faulty or not as described, you are responsible for the cost of returning goods to us.
Exceptions: the right to cancel does not apply to:
- Personalised or bespoke items made to your specification;
- Goods that are sealed for health or hygiene reasons (for example, certain bedding, cushions, or textiles) once you’ve unsealed them after delivery;
- Perishable goods (such as fresh plants or flowers, where applicable);
- Digital content once download or access has begun with your consent (see Section 9).
9. Losing the right to cancel: digital content
If you buy digital content that is not supplied on a physical disc or other tangible medium (for example, a downloadable file), the law allows you to cancel within 14 days unless you’ve asked us to start providing it to you straight away and you’ve acknowledged that doing so means you lose your right to cancel.
At checkout, we will ask for your express consent before starting to provide digital content, and confirm that you understand you will lose your cancellation right once we do. Once you’ve given that consent and we’ve begun supplying the content, you will not be able to cancel that order.
10. Faulty or misdescribed goods: your statutory rights
If a physical product you’ve bought turns out to be faulty, not as described, or not fit for purpose, you have the following statutory rights under the Consumer Rights Act 2015 (these are in addition to, and unaffected by, anything else in these terms):
- Short-term right to reject: within 30 days of delivery, you can reject faulty goods and get a full refund.
- Repair or replacement: after 30 days (or if you prefer this remedy), you can ask us to repair or replace the goods at no cost to you, within a reasonable time and without significant inconvenience.
- Price reduction or final right to reject: if a repair or replacement isn’t possible, doesn’t work, or takes too long, you can ask for a price reduction (up to 100% of the price) or reject the goods for a refund, which may include a fair deduction for use if more than six months have passed since delivery.
- If a fault appears within the first six months after delivery, it’s assumed to have been present at the time of delivery, unless we can show otherwise.
These rights apply for up to six years from delivery in England and Wales (or five years from when you became aware of the issue in Scotland), though in practice a claim must usually be brought within a reasonable time of a fault appearing. These rights exist regardless of any additional guarantee offered by us or a manufacturer.
To help us resolve your claim quickly, we may ask for photos or a short video showing the issue (and, where possible, the parcel as it arrived). Providing this helps us process your claim faster, and we may decline to treat a claim as established where we reasonably can’t verify it, without affecting your statutory rights.
11. How to return an item
To return an item, whether you’ve changed your mind (Section 8) or it’s faulty (Section 10), please contact us at support@homesophisticated.com first, including your order number, so we can guide you through the process and provide a returns address. Please return items in their original packaging where possible, though this is not a legal requirement for exercising your statutory rights.
12. Ownership of goods
Risk in the goods passes to you on delivery. Ownership passes to you once we’ve received payment in full. If a payment is declined or reversed without valid grounds, we may seek to recover the amount due.
13. Reviews and user content
If you leave a product review or submit other content to our site (such as photos or comments), you confirm it’s honest, based on genuine experience, and not misleading. We do not publish, commission, or incentivise fake reviews, and we take reasonable and proportionate steps to check that reviews on our site are genuine, in line with UK consumer protection law. We may remove any review or content that we reasonably believe is fake, misleading, defamatory, or otherwise breaches these terms. By submitting content, you grant us a non-exclusive, royalty-free licence to use, reproduce, and display it in connection with our business.
14. Acceptable use
You agree not to misuse our website, including by attempting to gain unauthorised access to our systems, introducing malicious code, scraping or reproducing our content without permission, or using our site for any fraudulent or unlawful purpose. We may suspend or terminate your account and cancel any pending orders if we reasonably believe you’ve breached this section.
15. Intellectual property
All content on our website, including text, images, logos, graphics, and the “Homesophisticated” name and branding, is owned by us or our licensors and protected by copyright, trade mark, and other intellectual property laws. You may view and download content for personal, non-commercial use only, and may not otherwise copy, reproduce, or exploit it without our prior written consent.
16. Our liability to you
16.1 What we cannot limit. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights under the Consumer Rights Act 2015, or for anything else that cannot lawfully be limited or excluded under English law.
16.2 Foreseeable loss. Subject to clause 16.1, if we breach these terms or fail to use reasonable care and skill, we are responsible only for loss or damage that is a foreseeable result of that breach or failure. Loss is foreseeable if it was an obvious consequence of the breach or if you and we both knew it was possible when the contract was made.
16.3 Indirect and consequential loss. Subject to clause 16.1, we are not liable for any loss that is indirect or consequential, meaning loss that is not a direct and foreseeable result of our breach.
16.4 Business losses. Our products are for domestic and private use. We are not liable for any loss of profit, loss of business, or loss of opportunity, and if you use a product for commercial or business purposes, we accept no liability for those losses.
16.5 Overall limit. Subject to clause 16.1, our total liability to you for all claims arising from a single order is limited to the price you paid for the products or digital content that the claim relates to.
16.6 Separate limits. Each of clauses 16.2 to 16.5 is separate and independent. If one is found to be invalid or unenforceable, the others continue to apply.
17. Events outside our control
We won’t be responsible for any delay or failure to perform our obligations under these terms if caused by events outside our reasonable control, such as extreme weather, industrial action, courier disruption, or failures of third-party suppliers. If such an event affects your order significantly, we’ll contact you and, where appropriate, offer a refund.
18. Complaints and alternative dispute resolution
If you’re unhappy with your order or our service, please contact us at support@homesophisticated.com, quoting your order number and describing the issue, with any photos or other evidence you have. This helps us investigate properly and put things right as quickly as we can.
We aim to acknowledge complaints within [2] working days and to give you our response within [14] days. Complex cases may take longer, and we’ll keep you updated if so. Once we’ve given you our final response, we aren’t obliged to continue correspondence on the same issue unless you provide new information, and we may decline to respond to complaints that are repeated, abusive or clearly unfounded.
If we haven’t been able to resolve your complaint, you may be able to refer it to an independent Alternative Dispute Resolution (ADR) provider. [We do not currently participate in ADR / We participate in ADR through [ADR Provider Name]]. Using ADR is optional for you, and this section doesn’t affect your legal rights, including your right to take legal action.
Complaints about how we handle your personal data are covered in our Privacy Policy.
19. Changes to these terms
We may update these terms from time to time to reflect changes in our business, our products, or the law. Any changes will apply to orders placed after the updated terms are posted; they won’t affect orders you’ve already placed with us. The “Last updated” date at the top of this page shows when it was last revised.
20. General legal terms
- Assignment: We may transfer our rights and obligations under a contract with you to another organisation, for example as part of a business sale or restructure, but this won’t affect your rights under these terms. You may not transfer your rights or obligations without our written consent.
- Severability: If any provision of these terms (or part of a provision) is found to be invalid, unlawful or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force. Each provision of these terms is separate and independent, including each limitation or exclusion of liability, and the invalidity of one does not affect the others. Where possible, an invalid provision will be treated as replaced by a valid one that comes closest to its original intention.
- Entire agreement: These terms, together with our Privacy Policy and any order confirmation, represent the entire agreement between us for your order.
- No waiver: If we don’t immediately insist that you do anything you’re required to do under these terms, it won’t mean we’ve waived our rights.
- Third-party rights: These terms are between you and us. No other person has any right to enforce any of these terms, except where the law says otherwise.
21. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction.
If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and you keep the mandatory consumer protections of the law where you live.
If you buy or use our products for business purposes, the courts of England and Wales have exclusive jurisdiction.
